1. Introduction

1.1. These Terms of Use and Service (“Agreement”) form a legally binding contract between Telmobil Inc (Simigo.ai) (“we,” “us,” or “our”) and you (“User,” “you,” or “your”) regarding your access to and use of the Simigo.ai website, AI SaaS platform, eSIM services, mobile applications, and related APIs (collectively, the “Platform”).

1.2. By using or accessing the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1.3. These Terms incorporate our Privacy Policy, Cookies Policy, and Data Processing Addendum (DPA), which together form the entire Agreement.

 

 

2. Registration and Account

2.1. To use certain features of the Platform (including AI tools, APIs, or eSIM provisioning), you must create an account and provide accurate information.

2.2. You must be at least 18 years old. Accounts may be suspended or terminated if we suspect misuse, false information, or illegal activity.

2.3. You are responsible for safeguarding your login credentials and all activity under your account.

 

 

3. User Obligations

You agree not to:

  • Use the Platform for any unlawful, deceptive, or fraudulent activity.

  • Interfere with the Platform’s operation, security, or network.

  • Reverse-engineer or copy any software, AI models, or APIs.

  • Use our AI tools or APIs to create competing services.

  • Use AI outputs in violation of any law, intellectual property, or privacy rights.

 

 

4. Intellectual Property & AI Content

4.1. All intellectual property rights in the Platform, including AI systems, APIs, software, and documentation, belong to Telmobil Inc (Simigo.ai) or its licensors.

4.2. AI-Generated Content — You own the outputs generated through your authorized use of Simigo.ai, provided they comply with these Terms and applicable laws. We may use aggregated, anonymized data to improve our AI systems and models.

4.3. License — We grant you a limited, non-exclusive, revocable license to access and use the Platform for personal or commercial use under your account.

 

 

5. eSIM & Connectivity Services

5.1. eSIM Services are provided through third-party telecommunications partners and subject to local regulations. Network performance may vary by country or carrier.

5.2. You are responsible for verifying device compatibility, ensuring lawful usage, and managing data plans via your Simigo.ai account or dashboard.

5.3. We may suspend or terminate service if usage is found to be abusive, fraudulent, or in violation of carrier policies.

 

 

6. Payments and Billing

6.1. Payments for subscriptions or data bundles are processed via secure payment gateways such as Stripe, PayPal, or in-app purchases.

6.2. By purchasing, you authorize us to charge your payment method for applicable fees, taxes, and renewals.

6.3. Refunds are processed according to our Refund Policy. Prepaid eSIMs are generally non-refundable once activated.

 

 

7. API Access

7.1. Simigo.ai provides API access for developers, resellers, and enterprise clients. API use must comply with all technical and security guidelines.

7.2. You may not share or resell API keys without written authorization.

7.3. Abuse of the API (including denial-of-service activity or mass scraping) may result in suspension or termination.

 

 

8. Data Protection & Privacy

8.1. We process your personal data according to our Privacy Policy and DPA.

8.2. Simigo.ai complies with GDPR, CCPA, and other relevant data protection laws.

8.3. You may request deletion, export, or correction of your personal data at any time.

 

 

9. Limitation of Liability

To the maximum extent permitted by law, Simigo.ai is not liable for:

  • Any indirect or consequential damages.

  • Service interruptions due to telecom partners or APIs.

  • Loss of data, profits, or business arising from use or inability to use the Platform.

 

 

10. Indemnification

You agree to indemnify and hold harmless Telmobil Inc (Simigo.ai), its employees, affiliates, and partners from any claim arising from your misuse of the Platform, breach of Terms, or violation of law.

 

 

11. Governing Law

These Terms are governed by the laws of the State of New York, USA, and subject to the exclusive jurisdiction of the courts of New York County.

 

 

12. Updates and Modifications

We may update these Terms periodically. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
